Uruguay has one important port and it is located in Montevideo, the Capital City. That allows an easy control of all the goods that are imported and exported to Uruguay and that enter the country by sea. Counterfeiters use Customs and Free Zones to export those goods to Argentina, Brazil, Chile and Paraguay. There is a large number of counterfeit goods which origin is “La Salada” black market in Argentina, as well as China. Approximately 60% of the seized goods in transit enter the country through Montevideo port or Carrasco Airport, with final destination Paraguay (Asunción or Ciudad del Este). Smuggled goods usually enter through Salto, Paysandú, Fray Bentos, Colonia, Chuy, Rio Branco and Rivera borders. Counterfeit goods in Uruguay are mainly commercialized in fairs and wholesale businesses.

Country Procedures

  • Customs application available and is valid for 1 year
  • Customs will not act ex officio? (except smuggling)
  • Deadline for response to Customs notification of detention is between 48 - 72 hours, but it is possible to request a term extension
  • Local authorities tasked with taking criminal action against infringers are Customs, Court, Police and Government Departments
  • Remedies available by law: seizure, imprisonment and fine (in civil procedures)
  • Proof of knowledge of counterfeiting is not required
  • Interim injunctions and contributory liability remedy  available
