Turkey is a very large market and due to its geographical position between Europe and Asia, it also represents an entry/transit point for goods coming from the border countries. Turkey is a vast country with a huge counterfeiting problem. This is why one of the focus of activities is on the Customs surveillance as well as on creating more units in different cities. REACT evaluated 7 years of counterfeiting activites in Turkey jointly with participating companies as well as a group of lawyers. The service we are offering in Turkey is good and at low costs. A professional investigation; a specialised IP law service as well as good contacts with law enforcement. It should be of interest to other brands owners and nothing prevents companies to cooperate with the REACT network in Turkey and maintain close contacts with its own brand protection facility in Turkey. Furthermore, the coast region of Turkey with popular tourist destinations is very often a target for counterfeit sellers. Customs and police cases can be followed up from initial info/seizure through storage/destruction organization and/or final court decision (when necessary). Main practice is swift resolving of cases by settlements whereby the costs are transferred to the infringer. The REACT Turkey office is constantly developing good cooperation with brand owners, the Customs and other authorities in charged for IP enforcement and it is active in training seminars and similar activities.

Country Procedures

  • Customs application available and valid for 1 year
  • Simplified procedure
  • Deadline for response to Customs notification of detention is 10 working days (extendable 10 more days) with application for action in case of existing Customs registration. If there is no registration it is 3 working days
  • Trademark issues are depending on a complaint in Turkey. In case of a complaint, Public prosecutor is tasked with taking criminal action against infringers
  • Criminal law remedies available: imprisonment (up to 5 years), fine (up to 15,000 EUR), criminal forfeiture and destruction of counterfeits, disqualification from commercial activities
  • Malicious intent of fraud is required for criminal liability
  • Damages must be substantiated or can be determined in fairness; pre-defined thresholds for calculating costs of procedure
