Slovakia with its location is popular transit country for Polish and Hungary markets. Customs are seizing the counterfeited goods ex officio or upon the request at the border and also in the internal market. Slovakia is managed by REACT Czech Republic with its detached office at the Slovak border and its staff is regularly visiting the customs offices and is participating at the raids. The detached office manages custom applications, amicable settlements of IP right infringements, administrative and criminal procedures. Further legal support in the IP matters can be provided by cooperating IP law firm under agreed favourable fees for REACT members. Training seminars for local authorities are organized once a year or upon request of the local custom offices.

Country Procedures

  • Customs application is mandatory for protection of the internal market (special POA needed) as well as of the external border
  • Customs application for the internal market is valid for two years, customs application for the external border is valid for one year
  • Simplified procedure is available
  • If Customs acts ex officio, an application for action must be filed within 4 days
  • Deadline for response to Customs notification of detention is 10 working days (3 working days for perishable goods), deadline for filing the civil complaint in case of filed objections against destruction may be extended for another 10 days
  • Public prosecutor is tasked with taking criminal action against infringers
  • Criminal law remedies available: conditional punishments, imprisonment, fine, criminal forfeiture and destruction of counterfeits
  • Malicious intent of fraud is required for criminal liability
  • Damages and satisfactions are sustained to right holders only at the civil proceedings
