In Japan the Customs Recordal procedure requires a comprehensive filing of documents for the products the brand is seeking to protect including photos and descriptions on how to distinguish counterfeit from genuine. Country Procedures

  • Customs application not mandatory, but recommended
  • Customs application is valid for maximum 4 years, then renewable
  • Photos of counterfeits and genuine products are required for Customs application so that Customs can distinguish counterfeits and genuine products. Trademark Registration in Japan is necessary.  Once Customs application is valid, seizure procedures go on 'Simplified procedure' track
  • Allegedly infringing importer must respond to Customs notification within 10 working days. If it is decided that the goods are infringing, Customs sends a “Notification of Decision” to importers.  If neither protests nor contact has been made, Customs will confiscate and destroy the goods
