REACT Italy is based in Milan and has been active since 2002. We offer a wide range of services and are able to assist members with a complete and extensive anti-counterfeiting programme. Thanks to our external legal counsel we are able to provide legal follow up of both criminal and civil cases. From Italy we also supervise actions in Hungary and Malta and manage customs cases in Slovenia.

Country Procedures

  • Customs application is mandatory is valid for 1 year
  • If Customs acts ex officio, an application for action must be filed within 4 days
  • Deadline for response to Customs notification of detention is 10 working days with application for action (3 working days for perishable goods), 4 working days for ex officio actions. The deadline can be extended
  • Deadline for importer to respond to seizure is within a 10 working days deadline
  • Local authorities tasked with taking criminal action against infringers. They shall proceed ex-officio if they have substantial evidence
  • Criminal law remedies available: imprisonment (up to 3 years), fine (up to 25.000 EUR), confiscation of tools and machinery used for the production and destruction of counterfeits
  • Interim injunctions are available
  • Damages and costs shall be requested only by filing a civil action, but it can be done only after the criminal proceeding is closed
