Country Procedures

  • Customs recordal is not available 
  • Customs procedures are not set out in sufficient detail
  • Customs will act ex officio
  • The police have authority to take criminal action against infringers
  • Undertakings, destruction of seized goods, and a public apology can generally be obtained in a post-raid settlement of a criminal action
  • Court-ordered remedies under the criminal law (i.e. where there is no post-raid settlement) have little deterrent effect
  • Interim injunctions and damages and costs are available
  • Proof of knowledge of counterfeiting is required
