REACT India services include Customs recordals (mandatory for effective confiscation of counterfeits crossing the Indian borders) and Custom enforcement along with conducting custom trainings at various ports in India. We also offer local enforcement including civil and criminal actions (through our partner law firm) as well as online monitoring along with effective enforcement of online targets: we keep an eye on repeat offenders and power sellers and try to ensure that their re-occurrence is controlled. REACT India also offers services of conducting test purchases and sending cease and desist notices at effective cost with local follow-up of cases.

Country Procedures

  • Customs application available/ implicitly mandatory for effective enforcement
  • Maximum term for a Customs application is five years, minimum term is one year
  • Simplified procedure
  • Customs will act ex officio, but recordal with Custom is mandatory for effective enforcement
  • Deadline for response to Customs notification of detention is 10 days maximum
  • Timeframe for importer to respond to seizure is 30 days of seizure
  • Enforcement action can be taken through a criminal complaint made to the Police
  • Remedies available under criminal law: imprisonment for up to three years; fine of up to Rs200,000; or both
  • Proof of knowledge of counterfeiting is not required
  • Ex parte orders, Interim injunctions, damages and costs are all available
  • Contributory liability remedy is also available, especially in case of Internet intermediaries
