It is said that in Greece, the whole country is a customs office and this certainly reflects the situation: the country’s large coastline in connection with its geographical position in the Eastern Mediterranean makes Greece a target for counterfeiters.  Greece is not only a crossroad for transporting quantities, but has also become a “logistics centre” for the distribution of counterfeits throughout Europe. Counterfeits are not only imported for third (non-EU) countries, but from EU countries as well. Not to mention the Greek islands and other popular summer resorts, where the problem is intense. Country Procedures

  • Customs application is available, either as a national or European filing. It is mandatory for Customs intervention and it proves representation of the brand owner in market proceedings, safe criminal proceedings where a notarized PoA is required
  • A Customs application is valid for a one-year term.
  • Simplified procedure is applicable under Regulation (EU) 608/2013, while there is a similar simplified procedure in market cases as well
  • Customs will act ex officio and then request from the brand owner to file a Customs application, per Regulation (EU) 608/2013 requirements
  • The deadline to respond to a Customs notification is 10 working days, which may be extended for another 10 working days
  • The importer should provide his response within the same time frame of 10 working days
  • The Police, the Coast Guard, the Financial and Economic Crime Unit (SDOE) and the Public Revenues Investigation and Safeguard Authority (Y.E.D.D.E.) are tasked with taking criminal action against infringers
  • Proof of knowledge of counterfeiting is required in order for an infringer to get convicted in criminal proceedings
  • In Civil and administrative proceedings, proof of knowledge is not required
  • Ex parte orders, in the firm of Temporary Restraining Orders, are available in civil/interim measures proceedings
  • Interim measures and contributory liability are available
  • Damages and costs recovery are claims available in civil proceedings
