In 2005 REACT established a close working relation with Estonian Customs and Police. On January 1st 2006, we merged all activities in the Baltic States and coordination and management is now done from the North East Europe Regional Office based in Vilnius, Lithuania. In 2012 REACT established partnership with local law frm Vares & Moistlik in order to provide REACT members with full scale legal support in Estonia. Customs enforcement in Estonia is carried out through simplified procedure in most cases. If necessary, additional measures, such as administrative or criminal, can be initiated against major infringers, as well as civil claims in order to obtain damage compensations. For storage and destruction of goods, the enforcement authorities sometimes request the support from rights owners. REACT is supporting its members in this respect.

Country Procedures

  • Customs application procedure is available and mandatory, however Estonian customs also prove to be effective with ex-officio seizures
  • Customs application is valid for the period of 1 year with the option to renew every year.
  • Simplified procedure is in place and very effective
  • Rights holder must respond to the customs notification within 10 business days. In case of explicit objection of the importer to the simplified procedure, there is an option to initiate an administrative or a criminal case with the customs or police
  • Under crimnal or administrative procedure, counterfeit goods are always destroyed and the sanction (penalty) is imposed on infringer. In addition, a civil claim can be filed in the criminal procedure in order to demand for damage compensation
