The Prague React office provides a number of high quality services to members, including procedures relating to: enforcement of counterfeits, domain name and parallel import fields including disputes, monitoring, administrative, criminal and civil measures.  React Czech Republic actively cooperates with local enforcement authorities on 24/7 basis and regularly organize training events for state officials. The team uses modern investigation techniques to track and trace infringers and conducts raids/seizures with local authorities. Further legal support in the IP matters is provided on all level of court instances. React Czech Republic also organizes prevention trainings at schools through its non-profit organization.

Country Procedures

  • Customs application is mandatory for protection of the internal market (special POA needed) as well as of the external border
  • Customs application is valid for one year
  • If Customs acts ex officio, an application for action must be filed within 4 days
  • Deadline for response to Customs notification of detention is 10 working days (3 working days for perishable goods), possibility of filing the civil action in case of filed objections against destruction is another 10 days
  • Public prosecutor is tasked with taking criminal action against infringers
  • Counterfeits are seized in the internal market by customs, trade inspectorate and police
  • Trade inspection seized goods based on the Act of the consumer protection with no obligatory to contact the member regarding the identification or the case itself
  • Criminal law remedies available: conditional punishments, imprisonment (up to 5 years), fine (up to 100.000 EUR),criminal forfeiture and destruction of counterfeits
  • Malicious intent of fraud is required for criminal liability
