Due to its strategically important geographical position Cyprus is often a target for counterfeit import, Especially at the most popular points of importation: Larnaca and Paphos airports, Limassol port, as well as the “Green Line” (a kind of border with the politically unstable north, from where counterfeit goods constantly come from mainland Turkey into the EU territory). Also, known as a popular touristic destination, Cyprus attracts quite large number of counterfeit sellers at its resorts, such as Agia Napa and Protaras. The main IP enforcement authority is the Customs Department; in 2003 they successfully implemented a simplified procedure. React has a partnership agreement with Drakopoulos Law Firm. Team head Michalis Kosmopoulos, is an IP expert in trademark enforcement.

Country Procedures

  • Customs application is available, either as a national or European filing. It is mandatory for Customs intervention
  • A Customs application is valid for a one-year term
  • Simplified procedure is applicable under Regulation (EU) 608/2013, while there is a similar simplified procedure in market cases as well
  • Customs will act ex officio and then request from the brand owner to file a customs application, per Regulation (EU) 608/2013 requirements. Since Customs is the main IP enforcement agency in Cyprus, they act ex officio in the market as well
  • Deadline for response to Customs notification of detention? The deadline to respond to a Customs notification is 10 working days, which may be extended for another 10 working days
  • The importer should provide his response within the same time frame of 10 working days.
  • The Police are tasked with taking criminal action against infringers; however the main agency for IP enforcement in Cyprus is Customs
  • Brand owner may file criminal complaints with the Police and seek conviction of the infringers. Proof of knowledge of counterfeiting is required in order for an infringer to get convicted in criminal proceedings
  • In Civil and administrative proceedings, proof of knowledge is not required
  • Ex parte orders, in the firm of Temporary Restraining Orders, are available in civil/interim measures proceedings
  • Interim measures and contributory liability are available
  • Damages and costs recovery are claims available in civil proceedings.
