Due to its geographical position Croatia represents an important point of entry/transit for goods coming from the Far and Middle East. Counterfeit goods coming on this route are sometimes heading for other Balkan countries but more often other western EU countries. For this reason we focus our activities on Customs surveillance, giving the Customs department as much assistance as possible. The Croatian coastline, with its popular tourist destinations, is often a target for counterfeit sellers. Since 2009 React has a partnership agreement with Marko Vazdar  - Vazdar Law Office based in Zagreb, an IP office specialized in IP enforcement. Customs and Police cases can be followed up from initial info/seizure through storage/destruction organization and/or final court decision (when necessary). Our priority is the efficient resolution of cases by settlements whereby the costs are transferred to the infringer. If this is not possible, further legal steps and related costs are taken, as previously discussed with the client. The office is constantly developing good cooperation with the Customs and other authorities in charged for IP enforcement and it is active in training seminars and similar activities.

Country Procedures

  • Customs application is mandatory (EU or national application)
  • Customs application is valid for one year

  • The deadline for response to Customs notification of detention is 10 working days (extendable)
  • The deadline for importer to respond to seizure is 10 working days (not extendable)
  • Local authorities will take criminal action in case of large quantities and high value
  • Remedies available under criminal law are seizure, destruction of infringing goods and damages
  • Intent is necessary for criminal offense of IP infringement
  • Ex parte orders are available if the adverse party fails to respond
