Costa Rica, officially the Republic of Costa Rica, is a country in Central America, bordered by Nicaragua to the north, Panama to the southeast, the Pacific Ocean to the west, and the Caribbean Sea to the east. The country is part of the Dominican-Republic Central America Free Trade Agreement as well as International Treaties having provisions related to the defense of intellectual property rights. It is worth mentioning the transit of goods through Paso de Canoas (border between Panama and Costa Rica).

Country Procedures

  • Customs will act ex officio
  • Deadline for response to Customs notification of detention is 10 days
  • Local authorities tasked with taking criminal action against infringers are: Customs, Police, Prosecutor and Court
  • Remedies available under law: seizure, fine and imprisonment
  • Proof of knowledge of counterfeiting is not required
  • Interim injunctions, contributory liability remedy, damages and costs are all available
